Australian Industrial Chemicals Bill 2017 Passed by Both Houses of Parliament

Three out of a package of six bills were passed by the two houses of the Australian Federal Parliament, including the Industrial Chemicals Bill 2017, the Transitional Provisions, and the Amendment Bills.

On February 14, 2019, the Industrial Chemicals Bill 2017 passed the Australian Senate with amendments. The amendments to the Bill were then approved by the House of Representatives on February 18.

Along with the Transitional Provisions and the Amendment Bills which have also been passed by both Houses of Parliament, the Bill will become Australian law upon the Royal Assent by the Governor-General.

In terms of the amendments proposed by the Senate, the most significant one is a change to obligations for introducers using the exempted category under the Australian Industrial Chemical Introduction Scheme (AICIS). According to the amended Bill, introducers should tell AICIS about chemicals introduced under the exempted category. This new requirement involves a once-off declaration at the end of the registration year in which each chemical is first introduced in this category. Rules will be developed to specify the information to be included in the declarations, as well as the exempted introductions that will not require such declarations.

The Bill was also amended so that the AICIS will commence on July 1, 2020. Meanwhile, the other three bills which are related to fees and charges under the AICIS are expected to be considered by the Senate in April 2019.
