China Hazardous Chemicals Legislation Coming Today

Coming China GHS and A New Round of Hazardous Chemicals Ruling

Several landmark regulations regarding the management of hazardous chemicals (HC) based on China GHS principle will officially enter into force at the beginning of December 2011, encompassing most of the HC markets in China, including manufacture/production, import, storage, use, sales, transport and evaluation.

The most important, the State Council Decree 591 identifies the main framework of HC management. It also initiates the practical implementation of China GHS. Click Here (Decree 591) for in-depth detail of this law.

A further revised regulation defining the Registration Obligations of HC has taken effect from today under the China SAWS order 2011-65. The revised Measures on Hazardous Substances Registration has incorporated new elements, such as essential qualifications for the registration office, training requirements, emergency response telephone requirements for hazardous chemical accidents, etc. The new Measures affect manufacturers and importers of hazardous chemicals. All chemicals listed in the Catalogue of Hazardous Chemicals shall be registered, while chemicals not listed in the Catalogue but identified as hazardous shall still be subject to the new Measures and be registered. Another regulation compiled by China’s MEP concerning the registration for environmental management of HC emission and release has completed the public consultation phase and is currently awaiting higher legislature approval. MEP order

Also decreed by SAWS, two measures on the 'HC Safe Use Permit' and 'HC Operation License' have been proposed/revised as the supporting documents for Decree 591. If chemicals produced or used in preparations reach a specified tonnage threshold, a 'HC Safe Use Permit' should be applied for. Measures on the HC Operation License re-define the three categories of licensing, which incorporates warehouse storage for the first time.

The remaining three provisions regulate respectively HC construction projects, supervision of major hazard installations and evaluation of HC safety production. More details on China’s HC regulations will be updated on our website this month.
