Designation and Publication of Toxic Chemicals in South Korea Is Delegated to NIER from 1 Jan 2018

The updated South Korea’s Toxic Chemical Substance List (TCSL) was issued on 30 Mar 2018 by NIER Announcement No. 2018-9

The changes made to "Designation of Toxic Chemicals, Restricted Chemicals and Prohibited Chemicals" specified as below have been approved by MoE Announcement No.2018-52 on 2 Apr 2018.

Currently, the updates of toxic chemicals, restricted and prohibited chemicals in South Korea are published and dynamically updated in successive MoE announcements named “Designation of Toxic Chemicals, Restricted Chemicals and Prohibited Chemicals”. The lists of toxic chemicals, restricted chemicals and prohibited chemicals are respectively updated as Annex1, Annex2-3, and Annex 4-5 of the announcement.

However, according to Article 31 (delegation and entrustment of authority) of K-REACH Enforcement Decree, the task for designation and publication of toxic chemical substances is delegated to the National Institute of Environmental Research (NIER) from 1 Jan 2018. Proposed by MoE Notice No.2018-147 (public consultation from 8 Mar to 28 Mar), the previous announcement will be re-named as “Designation of Restricted Chemicals and Prohibited Chemicals” and the Annex 1 for list of toxic chemicals will be deleted from the new announcement accordingly. MoE will review the appropriateness of this announcement and make improvements every three years counting from 1 Jul 2018.
