Philippines FDA Consults on GHS for Consumer Products

The Philippines Food and Drug Administration (FDA) is seeking public views on the first draft of the “Procedural Rules and Regulations Implementing the Globally Harmonized System (GHS) for Classification and Labelling of Household Hazardous Chemicals and Consumer Products Regulated by the Department of Health”. 

The Department of Health (DOH) has formulated this draft in response to the assignment of developing pertinent measures for adopting the GHS principles within its regulatory framework. The draft concerns all household hazardous chemicals and consumer products supervised by the DOH, yet substances that are not for intentional intake such as pharmaceuticals, food additives, cosmetics and pesticide residues in food are exempted.

The draft imposes extra obligations on the importers, distributors, manufacturers, users and transporters of toxic chemical and mixtures in the following aspects:

  •  Adopt the harmonized criteria for classifying substances and mixtures according to their health, environmental and physical hazards based on the GHS revised fourth edition or corresponding revisions/amendments.

  •  All importers, manufacturers, suppliers and distributors shall prepare the SDS and labels, as necessary and applicable.

  •  Appropriated pictograms, signal words, hazard and precautionary statements must be placed at the storage or warehouse facility/premises and on transport.

The requirements set out in the draft will apply to chemicals classified under RA 6969, including substances listed in the Chemical Control Order (CCO) and the Priority Chemicals List (PCL) within two years of the draft coming into force. After four years, it will also take effect on the high volume toxic chemicals, and after five to toxic chemicals under the International Air Travel Association (IATA) list of dangerous goods and International Maritime Dangerous Goods (IMDG) Code. On the seventh year and thereafter, mixtures should be managed.

So far, the Philippines has not yet implemented any regulations adopting the GHS, the closest attempt is the third and final draft of the Department of Environment and Natural Resources (DENR) Administrative Order 29 that was planned to enter into force in 2012 (ChemLinked news released 12 Oct 2012).
