SAWS Drafting More Regulations to Underpin Safe Management of Hazardous Chemicals in China

On Mar 10, General Office of China State Administration of Work Safety (SAWS) issued Notice No.(2016)44 announcing a comprehensive roadmap to enhancing work safety in 2016, which identifies 9 aspects requiring prioritized concern of the central and/or local competent authorities:

  1. Formulation and revision of relevant policies and standards

  2. Development and promotion of technological solutions

  3. Improvement of national statistical and analytical system

  4. Safety supervision on non-coal mines

  5. Comprehensive work safety supervision of industries and sectors of key concern

  6. Supervision on hazardous chemicals, fireworks and non-medical drug precursors

  7. Safety supervision on certain manufacturing and trade industries such as the metallurgical industry

  8. Supervision on occupational safety and health

  9. Training and propaganda

The notice sets a goal of promulgating the newly formulated Regulations on Emergency Response to Work Safety Accidents (《生产安全事故应急条例》) and finishing drafting Regulation on the Implementation of the Work Safety Law (《安全生产法实施条例》) in the first half of 2016.

Other legislative projects currently underway include Measures for Safety Supervision and Administration of Hazardous Chemicals (provisional title) (《危险化学品安全监督管理法(暂定名)》), Provisions on Safety Supervision and Administration of Hazardous Chemical Enterprises (《危险化学品企业安全监督管理规定》)、Provisions on Safety Management of Oil Depots (《石油库安全管理规定》) and so on.

Manual on Work Safety Supervision for Law Enforcement Executives (《安全生产监管执法手册》) will be published and implemented by the end of 2016.

More national standards, guidance and other supporting documents can be expected in 2016 and onward, such as the Implementation Guidelines for Chemical Process Safety Management (《化工过程安全管理实施导则》), Criteria for Acceptable Individual Risk and Social Risk from Production and Storage of Hazardous Chemicals (《危险化学品生产、储存装置个人和社会可接受风险标准》), User Manual of China Inventory of Hazardous Chemicals (《

In addition, inter-ministerial efforts are being made to accelerate the establishment of a national information system that will allow information sharing of different law enforcement departments across sectors and perform multiple functions including collecting Hazchem company profiles and relevant licensing information, monitoring major hazard installations, and keeping records of safety accidents and inspection results.
