Taiwan TCSCA Scheduled to Pass in Next Legislative Session

Since Consensus has been reached among the Legislative Party Caucuses on 25 June, the proposal is ready for submission for the second and third reading (CL news 28 June). Unfortunately, the passage of the TCSCA proposal failed to be included in the agenda of Legislative Yuan’s special session arranged from 29 July to 8 August. The review work of the amendments of TCSCA will be reopened until the next Legislative Session in latter half year, as early as September.

The TCSCA in force was promulgated on January 3, 2007. The amendments of TCSCA will adopt a core principle of registration scheme to require industries to submit information of manufactured or imported chemicals for further management of toxic chemical substances. If finally approved, initiatively the new chemical substances and the priority substances designated by Taiwan EPA will be managed under the registration scheme, and more rigorous requirements will be imposed on the handling of Class 4 toxic chemical substances.

The legislative progress of TCSCA proposal is summarized as below,

  • 1 Nov 2012, TCSCA passed by the Executive Yuan and handed to the Legislative Yuan for approval

  • 21 March 2013, Consensus reached on initial registration requirements for Class 4 toxic chemical substances

  • 29 May 2013, first reading of TCSCA passed by the Social Welfare and Environmental Affairs Committee, leaving 6 articles for further assessment

  • 25 June 2013, the 6 articles previously remaining up in the air after the first reading passed among the Legislative Party Caucuses
