Taiwan's Legislative Yuan Approved Revised TCSCA

The amendments of the Toxic Chemical Substances Control Act (TCSCA) passed its third reading in the Legislative Yuan on 22 Nov, 2013. Totally 17 articles are revised or newly added to the updated TCSCA. The registration provisions will take effect one year after the bill's promulgation.

The proposal passed the third reading without changes from the version agreed by all legislative parties in late June. The amended TCSCA will require manufacturers and importers to register designated substances prior to entering Taiwan’s market. Registration of existing chemical substances in separate phases will be applied (CL news 25 Oct 2013). Besides, the revised TCSCA will also encompass new chemical registration and includes registration of nanomaterials.

The full contents of the revised TCSCA should be published 14 days after the third reading. Companies should pay attention to the registration terms and conditions and check the existing chemical substance inventory (ECSI). Companies are suggested to generate some data in advance if they are already manufacturing or exporting new substances to Taiwan in high volumes. For low volume substances or those used for R&D purposes, a simplified or low-quantity registration is likely to apply, with less registration requirements compared with standard registration. Priority chemical substances which encompass substances traded, manufactured or utilized in high volumes, or those which pose severe risks to human health and environment also require standard registration. This PEC list will be released in three separated batches with higher priority substances published first. Registration dossiers will have to include data on physicochemical, toxicological, exposure and assessment data etc. The finer points of implementation are awaiting guidance documents to be delivered in the next year.

*As planned, three registration types possibly include standard registration, simplified registration, and low-quantity registration.
