Korean MoEL Reveals MSDS Compliance Supervision Results, 44.1% of Workplaces in Violations

On October 17, 2023, South Korea’s Ministry of Employment and Labor (MoEL) made public the supervision results on the MSDS compliance conducted from 10 July 2023 to 31 August 2023, targeting 220 chemical handling workplaces concerning the manufacture and import of chemicals or the toxic chemical disposal.

EPA Increases TRI Reporting Requirement for PFAS

The USA’s Environmental Protection Agency (EPA) is finalizing a rule to add per- and polyfluoroalkyl substances (PFAS) included on the Toxics Release Inventory (TRI) to the list of Chemicals of Special Concern. This final rule shall apply for the reporting year beginning January 1, 2024. (reports due July 1, 2025).

EPA Finalizes Rules for PFAS Data Reporting under TSCA

On October 11, 2023, the USA’s Environmental Protection Agency (EPA) published a finalized rule to require reporting and recordkeeping for per- and polyfluoroalkyl substances (PFAS) under the Toxic Substances Control Act (TSCA). This rule builds on over two years of progress on the Biden-Harris Administration’s action plan to combat PFAS pollution, safeguarding public health and advancing environmental justice, and is a key action in EPA’s PFAS Strategic Roadmap. It shall be effective on November 13, 2023.

Global Chemical Regulation Highlights | September 2023

In September of 2023, China set the aim to enact the Law on Safety of Hazardous Chemicals by the end of 2028. Japan proposed to prohibit the manufacture, import, and use of PFHxS, its isomers and their salts, and prohibit the import of certain products in which such chemicals were used. Australia proposed changes to the rules regarding chemical introduction categorization, reporting, and record-keeping under AICIS. South Korea disclosed chemicals names and CAS numbers of 257 new chemical substances previously registered under K-REACH as their CBI protection periods expired. Indian officials clarified mandatory declarations of IUPAC name and CAS number for import on an offline meeting.

California Moves Closer to Banning Toxic ‘Forever Chemicals’ in Cleaners

On September 13, 2023, California lawmakers advanced a bill to ban the toxic “forever chemicals” known as PFAS from household and institutional cleaners sold in the state. The bill cleared the Legislature and now heads to Gov. Gavin Newsom for his signature.

EU Bans PFHxS under POPs Regulation

EU officially lists perfluorohexane sulfonic acid (PFHxS), its salts and PFHxS-related compounds in Annex I to Regulation (EU) 2019/1021(POPs Regulation). The announcement came in the publication of Regulation (EU) 2023/1068 in the Official Journal of European Union on August 8, 2023. It shall enter into force 20 days after the publication.

EU Industry Opposes Proposed Ban on Fluoropolymers

Earlier in February 2023, an ambitious plan to restrict or even ban all PFASs was unveiled by the European Chemicals Agency (ECHA). This universal restriction proposal calls for the phase-out of around 10,000 PFASs used in a wide array of applications.

In July of 2023, China MEM required enterprises to fill in Hazchem business information on national platform. Taiwan EPA proposed amendments to the Permit Registration and Approval Regulations for Toxic and Concerned Chemical Substances. South Korea intended to update requirements for low-volume new chemical registration. Australia designated PFOA and decaBDE as chemicals subject to AICIS Authorization. India further delayed QCOs for 10 chemicals. Thailand's FDA notified WTO of the proposed updates of the notification requirements for Type 1 hazardous substances (only for items under the FDA's responsibility) for comments.
