South Korea Publishes Model Agreement for Joint Registration of PECs

South Korea’s Ministry of Environment (MoE) published a “Model Agreement for Joint Submission of Registration Documents of Chemical Substances” on 8 Apr, 2016. The model agreement is now available in both Korean and English for your reference.

The model agreement defines the requirements and processes for joint registration of the same priority existing chemical substance (PECs) under K-REACH. The first batch of 510 PECs was published on 1 Jul of 2015 and these chemicals should be jointly registered by 30 Jun of 2018. So far 179 PECs have a corresponding Lead Registrant (LR) for joint submission of registration dossier under K-REACH (after four rounds of LR election). ChemLinked has reported each LR election and will keep an eye on the follow-up elections.

When LR is elected, issues regarding consortium management, data gap analysis, data purchasing, cost sharing, dossier preparation and final submission for joint registration should be conducted. The agreement will be signed by all co-registrants and it shall be legally binding in the duration required for completion of the joint registration. However, a registrant could withdraw from this agreement by giving prior written notice at any time and such withdrawal shall be in force six months following the date of the written notice. The withdrawing registrant shall fulfill all payment obligations arising prior to the withdrawal. All remaining co-registrants shall continue to have the right to use the information made available by the member that has withdrawn.

Relevant costs incurred in generating test data for joint submission basically shall be equally shared by the co-registrants requiring that data. However, the tonnage band of each member shall be considered when the costs are shared.
